I'd like to find out about licences for delphi 5, is it possible to still
get a licenced version for personal use? I have enquired at borland sa and
been told a few times that it has been discontinued, and should get d7/8
instead , however id prefer to stick with delphi 5 ... i would prefer a
legal copy though...

and if its not possible to get a licensed version of delphi 5, what would
the legal implications be for using un unlicenced version to create
commercial software?

Well I find D7 is better than D5, but that's my opinion. To get a older
copy, ebay would (in theory) be your best bet. But there appear to a lot of
fraudulent sellers. If the price is too good to be true, it probably is.
Maybe you should just advertise in this group that you want to buy a copy?

Probably only your conscience would know (except for the fact that you
posted in this group).

Just be very careful purchasing Delphi on ebay. Some sellers don't tell you
that their product is the education version which doesn't allow development
(or maybe just selling?) of commericial software using it. I wanted another
copy of D6 for a part time coder so I purchase one on ebay. It was the
educational version. I had a heck of a time getting my money back from the
seller, but I did and eventually got a real copy of D6 Pro on ebay.

The best bet is to look for specific claims such as "Not Educational
Version, Full Retail".
