Do you remember... MS was succesful in stopping Lindows for product
name confusion and Lindows had to change its name to Linspire.

Monta Vista Linux, a wellknown name in embedded Linux, uses the domain
name mvista.com.

It will be fun, some time in the near future, with MS midway through an
expensive marketing campaign for its next-gen Windows, will have to
change the name due to a court case on product name confusion.

Won't matter, two totally different types of companies (let alone
countries). Trademarked name conflicts only occur if they occupy the same
"domain", that is to say they do the same type of business. A window
manufaturer and a software company are totally different.

www.vista.com is a software company, they are already suing MS.

This is a different company than the one mentioned above (vistawindows).
vista has a leg to stand on, vistawindows does not.

I wouldn't be so sure, given the success with which Intel has been suing
everyone with an "Inside" or "Intel" in their company names, logos or
mottos, I would be worried if MS took over the "Vista" and I had it in
my company name/logo.
Another example of similar conventional-wisdom-breaching suing success
would be the "Milka" brand.

I'd also point out the US government has a medical EMR system called VistA
which has been around for at least 10 years. I don't know if the government
can trademark/copyright it's own stuff though. It available via a FOIA
request....

Yes, it can, and we just did. The argument was basically to prevent
someone from FOIA'ing the software we developed, the exact data structures
we have, the publicly available information in it, and turn around and
re-sell it.
